1. Agreement to these terms
By accessing dirtproconstruction.com, contacting Dirt Pro Construction LTD by phone, text, or email, submitting a quote request, or engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
These Terms constitute the entire agreement between you and Dirt Pro Construction LTD regarding your use of this website and any services provided.
2. About Dirt Pro Construction LTD
Dirt Pro Construction LTD is a privately owned excavation company operating in Walkerton, Ontario, Canada. We provide residential, agricultural, and commercial excavation services including but not limited to gravel driveway construction, french drain and drainage solutions, septic system excavation, land clearing, foundation excavation, and trenching across Bruce County and surrounding areas.

3. Services
Quotes and estimates: All quotes provided by Dirt Pro Construction LTD are based on information available at the time of the site visit. Written quotes represent our firm price for the agreed scope of work. Any changes to scope, site conditions, or materials that were not foreseeable at the time of the quote may require a change order. No additional work will be undertaken without your written or verbal approval.
Scope of work: The specific scope, timeline, and price for each job will be set out in a written quote provided before work begins. By accepting a quote, you agree to the terms and scope described in it.
Scheduling: We will provide a locked start date for your project. If circumstances require us to adjust the start date, we will provide at least 3 business days’ notice unless the change is caused by weather, ground conditions, or circumstances beyond our control.
Site access: You are responsible for providing safe, legal access to the job site. This includes ensuring that any required permits are obtained prior to the start of work, that underground utilities are located and marked (contact Ontario One Call at 1-800-400-2255 before any dig), and that access roads and entry points are clear for our equipment.
Permits: It is your responsibility to obtain any permits required for the work unless otherwise agreed in writing. This includes building permits, septic permits, land use approvals, or any other regulatory approvals required by Bruce County, the Municipality of Brockton, or the Province of Ontario.
4. Payment terms
Payment terms will be set out in your written quote. Unless otherwise agreed:
- A deposit may be required to secure your scheduled start date
- Final payment is due upon job completion unless alternative terms are agreed in writing
- Accepted payment methods will be confirmed at the time of quoting
- Overdue accounts may be subject to interest charges and collection action
5. Text message communications — consent and terms
By providing your phone number to Dirt Pro Construction LTD — through our website contact form, by calling or texting our business number, or through any other channel — you expressly consent to receive text messages (SMS) from Dirt Pro Construction LTD.
These messages may include:
- Responses to your service inquiry
- Appointment reminders
- Job booking confirmations
- Pre-job and arrival notifications
- Project status and progress updates
- Weather delay or rescheduling notices
- Job completion confirmations

Message frequency: Varies based on your project stage. During an active project, you may receive several messages per week. Outside of active projects, messages are infrequent.
Opting out: Reply STOP at any time to stop receiving text messages. You will receive one confirmation message and no further messages will be sent. Reply HELP for assistance.
Message and data rates: Standard message and data rates may apply based on your mobile carrier plan.
No third-party sharing: Your phone number will not be sold or shared with third parties for marketing purposes.
6. Warranties and our commitment to you
Dirt Pro Construction LTD stands behind its work. Our commitments on every job are:
- One firm written price. We will not charge more than the agreed price without your prior approval of a written change order.
- A locked start date. If we need to reschedule, you will receive at least 3 days’ notice.
- A clean site on completion. Excess material will be hauled, ruts graded, and the site left finished.
- A 30-day follow-up. Dylan will contact you personally 30 days after every job to ensure the work is holding up as expected.
- We fix our mistakes. If any defect in our workmanship becomes apparent within a reasonable period following completion, we will return and correct it at no charge.
These commitments apply to workmanship and execution. They do not extend to conditions caused by factors outside our control, including but not limited to: ground movement from frost or drought, flooding or storm damage, interference by third parties, or changes in site conditions following project completion.
7. Limitation of liability
To the maximum extent permitted by law:
Dirt Pro Construction LTD’s total liability to you for any claim arising from our services or your use of this website shall not exceed the amount you paid us for the specific job giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, property damage not directly caused by our negligence, or any damages arising from circumstances beyond our reasonable control.
Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
8. Insurance
Dirt Pro Construction LTD is fully insured. A certificate of insurance is available upon request. You agree to maintain any insurance coverage that may be required for your property during the period of work.
9. Dispute resolution
If you have a concern about our work or services, please contact Dylan Schmidt directly at info@dirtproconstruction.com or 1 (519) 899-2717. We are committed to resolving disputes fairly and promptly.
If we are unable to resolve a dispute directly, either party may refer the matter to mediation before initiating legal proceedings. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings must be brought in the courts of Bruce County or the nearest jurisdiction with appropriate authority.
10. Website use
The content on dirtproconstruction.com — including text, photos, and service descriptions — is owned by Dirt Pro Construction LTD and may not be reproduced, copied, or distributed without written permission.
We make reasonable efforts to keep website content accurate and up to date. However, we make no guarantees about the accuracy, completeness, or availability of website content. Service offerings, pricing estimates, and availability are subject to change.
